Do you need an attorney for your car accident?
Like all great legal answers, the answer is, IT DEPENDS. It depends, on the your injuries, who was at fault, and if any auto insurance exists to pay for your injuries. Lets examine those points one by one:
- Are you injured? Well you don’t really need an Injury Lawyer if you are not injured. If it’s a small accident and there are no injuries, simply get the car fixed through your insurance or through the defendant’s insurance and move on. Of note, I have seen people who don’t appear to be injured at first, but a few days after the accident injuries related to the car accident surface. There is no rush to settle these cases. The statute of limitations in Texas for personal injury cases against an at fault defendant is 2 years from the date of the accident. Meaning, you have two years to settle the case or file a lawsuit.
- Who is at fault? Many times it is easy to determine fault. For example, 99% of all rear enders are the fault of the person who did the rear-ending. But not all accidents are this simple. I advise you to call us immediately following an accident so we can determine the fault, based on our analysis of the Transportation Code.
- Is there applicable auto insurance? Does the other side carry automobile insurance? If not, do you carry Uninsured Motorist coverage; if so and points 1 and 2 above have been met, then you have a case and you need an attorney.
