As a general rule, the pedestrian has the right of way, but if the pedestrian clearly violates the light or jaywalks across a street there will likely be some contributing liability. If you are ever involved in a pedestrian accident, first and foremost get medical attention. If you are able, take photographs of your injuries, the street lights and conditions, the damage to the vehicle. Get the defendant’s information which includes Name, Drivers license number, Date of Birth, etc. Sometimes, taking a picture of the defendant’s ID is easier than scrambling for pen and paper in your time of agony. Also important, if there are any witnesses, take their information down as well. Many of our pedestrian cases hinge on a witnesses’ account of the events. Make a note, or take a photograph of any cameras in the area which may have documented the incident.
